One-on-One Trading Education and Coaching

These Terms of Service ("Terms") govern participation in one-on-one trading education and coaching services ("Coaching Services") provided by Jonathan McKeever, doing business as Trendy Elite Investments, a trade name of Trendy Consulting, LLC.

By purchasing, scheduling, accessing, or participating in the Coaching Services, you ("Client," "Student," or "you") acknowledge that you have read, understood, and agree to these Terms.

1. PURPOSE OF THE COACHING SERVICES

The Coaching Services are designed for educational/entertainment purposes and are intended to teach trading concepts, processes, techniques, and methodologies used by Jonathan McKeever.

Topics may include, but are not limited to: Supply and demand analysis, market structure, Fibonacci analysis, Fibonology, technical analysis, multiple-timeframe analysis, entry and exit concepts, risk management, risk-to-reward analysis, trade planning, trade review, trading psychology, journaling, Trendy Precision, Pre-Market Zones ("PMZ"), and other methodologies, tools, indicators, and processes.

The purpose of the Coaching Services is to help students understand and apply a trading methodology. Coaching is not intended to provide a personalized investment management service.

2. EDUCATIONAL SERVICES ONLY

All information provided through the Coaching Services is provided for educational and informational purposes only.

Nothing communicated during a coaching session, including discussion of a particular security, futures contract, option, cryptocurrency, price level, entry, exit, stop, target, position, strategy, or market condition, should be interpreted as a guarantee of results or as an instruction that the Client must enter, exit, or modify a particular trade.

Examples discussed during coaching may include historical trades, current market conditions, hypothetical trades, simulated trades, or trades personally considered or taken by the coach. These examples are used to demonstrate the methodology and educational concepts.

The Client is solely responsible for determining whether any trade or investment is appropriate for the Client.

3. NO ACCOUNT MANAGEMENT OR TRADE EXECUTION

Trendy Consulting, LLC does not take custody or control of Client funds or brokerage accounts as part of these Coaching Services.

Unless separately agreed in writing through a legally authorized service, Trendy Consulting, LLC will not: Access the Client's brokerage account, Place trades on behalf of the Client, Exercise discretionary trading authority over the Client's account, Direct the Client's broker to execute transactions, or Take possession or custody of the Client's trading capital.

The Client maintains complete control over all trading and investment decisions.

4. TRADING INVOLVES SUBSTANTIAL RISK

Trading stocks, options, futures, cryptocurrencies, and other financial instruments involves substantial risk and is not appropriate for every person.

Trading may result in the loss of some or all capital committed to trading. Certain products, including options, futures, leveraged products, and margin accounts, may involve particularly significant risk.

Clients should never trade money they cannot afford to lose.

The Client acknowledges that no trading methodology, indicator, strategy, coach, software product, technical analysis technique, or risk-management system can eliminate the risk of loss.

5. NO GUARANTEE OF PERFORMANCE

Trendy Consulting, LLC makes no representation, warranty, or guarantee regarding trading performance.

Past performance does not guarantee future results.

Any performance examples, winning trades, losing trades, percentages, profit figures, account results, screenshots, hypothetical results, or other examples discussed during coaching are provided for educational and illustrative purposes and should not be interpreted as a promise or expectation of similar results.

Individual results vary significantly based on factors including experience, capital, position sizing, risk tolerance, execution, market conditions, discipline, commissions, fees, slippage, and other factors.

6. CLIENT MAKES ALL TRADING DECISIONS

The Client understands and agrees that all trading and investment decisions remain the Client's responsibility.

Even when the coach discusses what he personally sees in a market, what he personally would consider doing, or how Trendy Consulting, LLC would analyze a particular chart or market condition, the Client must independently determine whether to take any action.

The Client is responsible for evaluating his or her own financial circumstances, risk tolerance, trading experience, and objectives and, when appropriate, consulting qualified financial, tax, legal, or other professional advisers.

7. LIVE MARKET AND CHART REVIEW

Coaching sessions may include analysis of live markets, charts, positions, or trades.

The Client may choose to show the coach charts, trading ideas, trade history, journal entries, or positions for educational review.

Any discussion of those materials is intended to teach the Client how the Trendy methods may be applied and should not be interpreted as a guarantee that a particular position will succeed or that a specific action must be taken.

Markets can move rapidly, and information discussed during a session may become outdated immediately after it is discussed.

8. INTELLECTUAL PROPERTY

The Coaching Services may include proprietary concepts, methodologies, terminology, indicators, systems, processes, educational materials, charts, presentations, videos, documents, worksheets, software, and other intellectual property owned by or licensed to Trendy Consulting, LLC.

This may include proprietary material associated with the Trendy methodology, Trendy Edges, Trendy Fibonology, Trendy Precision, PMZ concepts, and related educational systems.

Purchasing Coaching Services grants the Client a limited, personal, non-exclusive, non-transferable right to use the educational material for the Client's own personal education.

Unless Trendy Consulting, LLC provides prior written authorization, the Client may not reproduce, distribute, sell, sublicense, publish, upload, teach, commercially exploit, reverse engineer, or create competing educational products from proprietary Coaching Materials.

9. RECORDING AND DISTRIBUTION

The Client may not record, livestream, rebroadcast, publish, or distribute a Coaching Session without prior written permission from Trendy Consulting, LLC.

This includes audio recordings, video recordings, screen recordings, screenshots intended for distribution, transcripts, AI-generated transcripts, or other reproductions of substantial portions of a Coaching Session.

Trendy Consulting, LLC may request permission to record sessions for training, quality control, educational, or other legitimate business purposes. Any such recording practices will be disclosed as required by applicable law.

10. CONFIDENTIALITY

Information shared during coaching may include proprietary trading concepts and confidential educational material.

The Client agrees not to disclose or commercially distribute proprietary Coaching Materials to third parties without authorization.

Trendy Consulting, LLC will use reasonable care when handling personal information provided by the Client, subject to applicable law and the website Privacy Policy.

11. SCHEDULING, CANCELLATIONS, AND NO-SHOWS

Coaching sessions must be scheduled through the scheduling process designated by Trendy Consulting, LLC.

Clients must provide at least 24 hours' notice to reschedule or cancel a session.

Sessions cancelled with less than the required notice, or sessions for which the Client fails to appear, may be considered used and may not be eligible for a refund or replacement session, except where otherwise required by law.

If Trendy Consulting, LLC must cancel a session, the Client will be offered a reasonable opportunity to reschedule.

12. FEES AND REFUNDS

The price of the Coaching Services will be disclosed before purchase.

Except as otherwise expressly stated at the time of purchase or required by applicable law, coaching fees become non-refundable once the applicable Coaching Service has been delivered.

For packages containing multiple sessions, Trendy Consulting, LLC's posted refund and cancellation policy will apply.

Any applicable refund policy presented on the checkout page or order form is incorporated into these Terms.

13. TECHNOLOGY

Online Coaching Services may rely on third-party technology, including video conferencing, charting platforms, brokerage platforms, internet connections, market data providers, and other software.

Trendy Consulting, LLC does not guarantee uninterrupted availability or accuracy of third-party services.

If a significant technical issue prevents a scheduled coaching session from reasonably occurring, Trendy Consulting, LLC may reschedule the affected session.

14. CLIENT CONDUCT

Clients are expected to behave professionally and respectfully during Coaching Sessions.

Trendy Consulting, LLC reserves the right to terminate a session or coaching relationship for abusive, threatening, fraudulent, unlawful, harassing, or seriously disruptive behavior.

Any refund associated with termination will be determined in accordance with the applicable purchase terms and law.

15. THIRD-PARTY PRODUCTS AND SERVICES

During coaching, Trendy Consulting, LLC may discuss or demonstrate third-party brokerage platforms, charting platforms, software, market-data services, or other products.

Unless expressly stated otherwise, those third parties are independent businesses and are responsible for their own products and services.

Any material financial relationship, affiliate arrangement, or compensation associated with a recommended third-party product should be disclosed where required.

16. TAX AND LEGAL MATTERS

The Coaching Services do not constitute tax or legal advice.

Questions involving taxes, business entities, securities laws, regulatory requirements, estate planning, or other legal matters should be addressed with an appropriately qualified professional.

17. ASSUMPTION OF RISK

By participating in the Coaching Services, the Client acknowledges the speculative nature of trading and voluntarily assumes the risks associated with his or her independent trading decisions.

The Client understands that education and coaching cannot eliminate trading losses and that learning a methodology does not guarantee profitability.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Trendy Consulting, LLC and its owners, employees, contractors, affiliates, and representatives will not be liable for trading losses or investment losses resulting from decisions independently made by the Client based upon educational information obtained through the Coaching Services.

Nothing in these Terms is intended to waive or limit any right, remedy, obligation, or liability that cannot legally be waived or limited under applicable law.

19. INDEPENDENT RELATIONSHIP

Participation in Coaching Services does not create an employment relationship, partnership, joint venture, agency relationship, or other business relationship between the Client and Trendy Consulting, LLC except for the contractual relationship established by these Terms.

20. AGE REQUIREMENT

Clients must be at least 18 years old and legally capable of entering into a binding agreement.

21. WEBSITE POLICIES

The Client also agrees to any applicable Privacy Policy, Refund Policy, Risk Disclosure, and other policies posted on the Trendy Elite Investments website and incorporated into these Terms.

If a separate written agreement for a particular Coaching Service conflicts with these Terms, the separate written agreement will control to the extent of the conflict.

22. GOVERNING LAW

These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction's mandatory law provides otherwise.

Any dispute-resolution, venue, arbitration, or other enforcement provisions should be interpreted and enforced only to the extent permitted by applicable law.

23. CHANGES TO THESE TERMS

Trendy Consulting, LLC may update these Terms periodically.

The version applicable to a Coaching Service will generally be the version in effect when the Client purchases that service, unless a change is required by law or the Client agrees to updated terms.

24. ACKNOWLEDGMENT

By purchasing or participating in the Coaching Services, the Client acknowledges that:

The Client understands that the Coaching Services are educational in nature. The Client understands that trading involves substantial risk. The Client understands that profits are not guaranteed. The Client remains responsible for all trading decisions and account activity. The Client understands that examples discussed during coaching do not guarantee future performance. The Client agrees to protect Trendy Consulting, LLC's proprietary educational materials and intellectual property. The Client has read and agrees to these Terms of Service.
